Acting as a responsible direct lender:

Automotive Finance Associates Ltd t/a AFA Car Finance take the security of your personal data seriously and have a legal obligation to take steps to ensure that our customers are creditworthy. We use a variety of methods to make sure that we do not lend money to people who are in financial difficulty. One of these is to carry out a credit reference check.

What we collect:

When you make an application for finance, whether via an introducer, online, by telephone or in person, we will collect personal information from you in connection with the goods or services we may supply to you. We will collect other information relevant to the application such as wage slips, bank statements and copy of driving licence, and we will collect information from third parties such as credit reference agencies (CRA’s) and fraud prevention agencies (FPA’s).

How your information will be used:

Any personal information we collect from you – and that of any joint applicant – will be treated confidentially and your information will be used by us so that we and any other suitably authorised companies that we have any dealings with, either now or in the future, can manage your contract and relationship with us. We will share your information with credit reference agencies (CRAs) and other organisations for use in credit making decisions, for fraud prevention and to pursue debtors. You can contact the CRA’s in writing to request the information that they hold about you (please note a small statutory fee may be payable). We process your personal data on the basis that we have a legitimate interest to verify identity, prevent fraud and money laundering in order to protect our business interests and to comply with our legal obligations. With the exception of the above, we will not disclose any information to any other organisation outside of Automotive Finance Associates Ltd unless we are required to do so for legal or regulatory purposes. We will not share your information with third parties for marketing purposes. If we enter into an agreement with you, your details will be retained throughout the life of the agreement and for an additional period of six years after the completion of your agreement or as long as is deemed necessary. When you enter into an agreement with us, we will give details of your account(s) and how you manage them to CRA’s. If you borrow and do not repay in f outstanding debt. This information may be supplied to other organisations by CRA’s and FPA’s to perform similar checks and recover any debts that you may owe. If your application for finance is declined, we aim to securely shred all personal data you have supplied after a period of three months have passed. All information you provide is stored in secure servers and is kept within the EEA (European Economic Area). If you give us false or inaccurate information and we suspect or identify fraud we will record this and may pass this information to FPA’s and other organisations involved in crime and fraud prevention. If you have borrowed from us and do not make payments that you owe to us, we will trace your whereabouts and recover debts. The CRAs have produced a standard Credit Reference Agency Information Notice (CRAIN) which sets out how data will be processed by the three CRAs, namely, Experian, Equifax and Call Credit. Your Rights:

Where we have requested your consent to use your information in a particular way and you have given that consent, you may withdraw that consent at any time. You can do this by notifying us in writing to the Data Controller at the address below. The General Data Protection Regulation gives you a number of rights:
• The right to be informed;
• The right to access your personal data;
• The right to rectification of your personal data;
• The right to have your personal data erased (the right to be forgotten);
• The right to restrict processing;
• The right to data portability;
• The right to object;
• The right not to be subject to automated decision making.
If you require further information, or wish to make a complaint, you may contact our Data Controller,
whereupon we will investigate any enquiry or complaint. You also have the right to make a complaint with
the Information Commissioners Office (ICO) following attempts to redress any complaint with us.
You may also request details of information we hold on you. If you believe we hold inaccurate information
you may contact us in writing to the address below.
We may require satisfactory proof of your identity before we are able to disclose any information.

Acting as a Broker:

In cases where we act as a Broker to enable the best possible outcome for our customers, we may
introduce your application to selected partner finance companies where we feel this would be in the best
interests of our customer. We may receive a commission for such introductions however the type or level
of this commission would not affect the amount you would repay to our partner finance companies.
